These Terms and Conditions explain the rules and requirements that apply when you visit our website, register for our programs, book a clinical appointment, or use any of our services. We are committed to delivering our services with transparency, professionalism, and care.
By using this website or our services, you agree to be bound by these Terms and Conditions. These Terms should be read together with our Privacy Notice, available at https://www.smartperformance.ca/privacy-notice, which explains how we collect, use, and protect your personal information.
SMART Performance Training Centre & Clinic (“SMART Performance,” “we,” “us,” or “our”) is a physical performance and clinical rehabilitation facility located at 5709 2nd Street SE, Unit #113, Calgary, Alberta T2H 1H8. We operate under two integrated divisions:
- Training Division – Athletic performance, fitness programs, personal training, and online programming
- Clinical Division Physiotherapy, massage therapy, and data-driven rehabilitation
References to “you,” “Client,” or “Participant” refer to any individual who accesses our website, registers for our programs, books a clinical appointment, or submits any form on our website.
If you are registering or submitting information on behalf of a minor, you represent that you are the parent or legal guardian of that minor and you agree to these Terms on their behalf.

We offer a range of athletic performance and fitness programs, including:

- Online Personalized Workouts

Clinical Services
Our integrated clinic offers evidence-based health and rehabilitation services, including:
- Physiotherapy (including ACL rehabilitation, sports injury rehabilitation, and dry needling)
- Massage Therapy
- VALD® Human Performance Testing and data-driven rehabilitation
Online Services
We may offer online resources, personalized workout programming, and client communications through our website and third-party platforms, including JaneApp for clinical bookings. Use of these platforms is subject to their own terms of service and privacy policies.
We reserve the right to modify, suspend, or discontinue any service at any time. We will make reasonable efforts to notify you of material changes to services you are actively enrolled in.
Training Program Registration
Registration for training programs is completed through our website or by contacting our team directly. Program spots are confirmed upon receipt of your registration and any required deposit or full payment. By registering, you confirm that the information you provide is accurate, current, and complete.
Clinical Appointments
Clinical appointments (physiotherapy, massage therapy) are booked through JaneApp at smartperformance.janeapp.com. Appointment availability is subject to change. Please arrive on time — late arrivals may result in a shortened session at full cost.
Accuracy of Information
You agree to provide accurate information when registering or booking. Providing false or misleading information may result in termination of your registration or participation. Please refer to our Privacy Notice for details on how registration information is collected and used.
Pricing
Fees for training programs and clinical services are as listed on our website or as communicated to you at the time of registration or booking. All prices are in Canadian Dollars (CAD) and are subject to applicable taxes.
Payment
Payment is due at the time of registration or as outlined in your program agreement. Failure to complete payment by the due date may result in loss of your reserved spot.
Insurance Coverage (Clinical Services)
Many of our clinical services may be eligible for coverage under extended health benefits. It is your responsibility to verify coverage with your insurer prior to booking. SMART Performance does not guarantee reimbursement and is not responsible for denied insurance claims.
Late Payments
Invoices not paid within the agreed timeframe may be subject to a late fee. We reserve the right to suspend access to services for unpaid balances.
Training Programs
Cancellation policies vary by program. Please contact us at admin@smartperformance.ca for the applicable cancellation policy before registering. Refunds, if applicable, are processed within a reasonable timeframe.
Clinical Appointments
We require a minimum of 24 hours’ notice to cancel or reschedule a clinical appointment. Late cancellations or no-shows may be subject to a cancellation fee. Repeated no-shows may result in suspension of booking privileges.
Open Gym and Drop-In Classes
Drop-in sessions and open gym passes are generally non-refundable once purchased. Unused passes may be credited to your account at the sole discretion of SMART Performance management.
Medical Clearance
Participation in physical training or rehabilitation programs involves inherent physical risk. You are responsible for ensuring you are medically cleared to participate. We strongly recommend consulting your physician before beginning any program, particularly if you have a pre-existing health condition or injury.
Disclosure of Health Information
You agree to disclose any relevant health conditions, injuries, or physical limitations to your coach or clinician before commencing any session. Health information you provide is collected and protected in accordance with our Privacy Notice. Failure to disclose relevant health information releases SMART Performance from liability for any resulting harm.
Assumption of Risk
You acknowledge and accept that participation in physical training, performance programs, physiotherapy, massage therapy, or any other service offered by SMART Performance carries inherent risks, including but not limited to: muscle strains, sprains, fractures, cardiovascular events, or other physical harm. You voluntarily assume all such risks.
Compliance with Instructions
You agree to follow all instructions provided by SMART Performance coaches, physiotherapists, and staff. Failure to follow instructions or engaging in unsafe behaviour may result in removal from the session or program without refund.
Facility Rules
You agree to comply with all facility rules, including proper attire, safe use of equipment, hygiene standards, and any posted guidelines. Disrespectful or unsafe behaviour toward staff or other participants will not be tolerated and may result in permanent removal from our programs.
Certain services — including physiotherapy and dry needling — require a signed consent form before treatment begins. Consent forms are available at https://www.smartperformance.ca/consent-form. No clinical service will be performed without a valid, signed consent on file. Consent may be withdrawn at any time; however, withdrawal of consent may affect our ability to provide certain services.
Our training programs welcome participants of all ages and ability levels. Participants under the age of 18 must have a parent or legal guardian complete all required consent and liability forms prior to participation.
By registering a minor, the parent or guardian assumes full responsibility for that minor’s participation and agrees to these Terms on their behalf. We may collect limited personal information from or about minors when necessary to fulfill enrollment or service requests. In all such cases, verifiable parental or guardian consent is required. Your personal and health information is collected, used, and protected in accordance with our Privacy Notice, available at https://www.smartperformance.ca/privacy-notice, as well as applicable privacy laws including Alberta’s Personal Information Protection Act (PIPA) and the Health Information Act (HIA).
By using our services, you consent to the collection and use of your information as described in our Privacy Notice. This includes information you provide through registration forms, contact forms, booking systems, and direct communications with our team.
You may exercise your rights regarding your personal information — including access, correction, and deletion — by contacting us using the methods provided in our Privacy Notice.

SMART Performance may photograph or record sessions, events, and client achievements for use in marketing, social media, and educational materials. By participating in our programs, you grant SMART Performance a non-exclusive, royalty-free license to use your likeness in such materials, unless you provide written notice to admin@smartperformance.ca requesting to opt out.
We will never share identifiable clinical images or health-related media without your explicit written consent.
All content on our website and materials — including training methodologies, program content, logos, text, graphics, and videos — is the property of SMART Performance Training Centre & Clinic or its licensors and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use any of our content for commercial purposes without prior written permission.
You agree to use our website only for lawful purposes. You must not:
- Use the website in any way that violates applicable local, provincial, or federal laws or regulations
- Attempt to gain unauthorized access to any part of the website or its underlying systems
- Use automated tools to collect data from our website without our express written permission
- Transmit any harmful, offensive, or misleading content through contact forms or communications
We are not responsible for the content, practices, or privacy policies of any third-party websites linked from our site. Visiting third-party links is at your own risk.
To the maximum extent permitted by applicable law, SMART Performance Training Centre & Clinic, its owners, directors, coaches, physiotherapists, therapists, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your participation in our programs or use of our website or services.
This includes, without limitation, any injury, illness, loss, or damage arising from physical training or clinical treatment, equipment failure, or the acts or omissions of other participants.

You agree to indemnify, defend, and hold harmless SMART Performance Training Centre & Clinic and its owners, employees, coaches, and clinicians from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your participation in any program or service; (b) your violation of these Terms; (c) your breach of any applicable laws; or (d) any injury caused to yourself or others as a result of your actions during a session or on our premises.
SMS Terms & Conditions
By providing your phone number and opting in to receive SMS communications from SMART Performance TC Inc., you consent to receive transactional and/or promotional text messages related to our services and programs.
These messages may include:
• Appointment and booking confirmations
• Session reminders
• Program and training updates
• Consent form notifications
• Payment reminders and account notifications
• Customer support communications
• Promotional offers, event announcements, and marketing campaigns
Message frequency may vary depending on your interaction with our services. Message and data rates may apply.
To opt out of SMS communications at any time, reply STOP to any text message received from SMART Performance TC Inc. After opting out, you will no longer receive SMS messages unless you opt in again.

Wireless carriers are not liable for delayed or undelivered messages.
SMS services are intended for users who are 18 years of age or older, or minors who have received consent from a parent or legal guardian.
SMART Performance TC Inc. only sends SMS messages to individuals who have provided express consent to receive communications. SMS consent and phone numbers will not be shared, sold, rented, or disclosed to third parties or affiliates for marketing purposes.
